General Terms and Conditions (GTC)
These general terms and conditions (hereafter “GTC”) apply to all business relations between Jungle Leaves – Alexander Ruppert, Patrick Schlütting, Nils Schmitz GbR (hereafter “Jungle Leaves” or “Seller”) and the Customer, in their valid version at the time of the order. No additional conditions between the seller and customer’s apply, unless agreed upon. These GTC are translated from the German original into English for the convenience of our international customers and are not legally binding. Only the original German version of the GTC is valid.
All prices quoted are in euros including the country-specific VAT, which is shown on the invoice (e.g. Germany: 19% VAT or 7% VAT). This applies to deliveries within the EU. Additional delivery and shipping costs are indicated separately during the checkout process or in the respective product description.
If prepayment by bank transfer has been agreed, payment is due immediately after conclusion of the contract, unless the parties have agreed on a later due date.
If you choose to pay by invoice, the purchase price is due after the goods have been delivered and invoiced. In this case, the purchase price must be paid within 7 (seven) days of receipt of the invoice without deduction, unless otherwise agreed upon. The seller reserves the right to offer the invoice payment method only to certain customers and only up to a certain order volume.
If the payment method “PayPal invoice” is selected, the seller cedes his payment claim to PayPal. Before accepting the seller’s declaration of assignment, PayPal may carry out a credit check using the customer data provided. The seller reserves the right to refuse the customer the “PayPal invoice” payment method in the event of a credit check result. All offers in the seller’s online shop are non-binding and are only valid while stocks last. The product descriptions contained in the seller’s online shop do not represent binding offers on the part of the seller, but serve to submit a binding offer by the customer.
The customer can submit an offer via the order process integrated in the seller’s online shop. After going through the ordering process, the customer submits a legally binding offer of contract for the goods in the shopping cart by clicking the button that concludes the ordering process. German and English languages are available for the conclusion of the contract.
The seller can accept the customer’s offer by sending the customer a written order confirmation or an order confirmation in text form (e-mail), or by delivering the ordered goods to the customer, or by asking the customer to pay after placing their order prompts.
If there are several of the aforementioned alternatives, the contract is concluded at the point in time at which one of the aforementioned alternatives occurs first.
With our large range of living plants, certain products may not be available even though they are still displayed as available. In such cases we do not supply any substitute plants and contact the customer. Deviations from the images or descriptions are natural in the case of plants and are no reason for claims. Errors are expected. These are ornamental plants that are not intended for consumption.
We always endeavor to ship our plants in a healthy and perfect condition and correctly identified. Shipping is via DHL.
The risk of loss or damage to the shipment is transferred to the customer when we deliver the goods to the shipping company. When processing the transaction, the delivery address specified in the seller’s order processing is definitive.
In the event of obvious damage or consignments that are clearly too late, the recipient must open or reject the parcel in the presence of the deliverer. If the shipment is accepted in such cases or if the shipment is lost, the customer must apply for compensation directly to the shipping company. If the customer does not comply, this has no effect on his statutory or contractual claims for defects.
Upon arrival, the customer must immediately inspect the goods for defects and report them to Jungle Leaves immediately in writing or by telephone. If the seller is responsible for these defects, Jungle Leaves is granted the right to resend undefective products. If a shipment is returned to Jungle Leaves through the fault of the customer, e.g. undeliverable or incorrect address information, the customer will be subsequently charged for the shipping costs or withheld.
Consumers generally have a right to cancel. More detailed information on the right of cancellation can be found in the seller’s cancellation policy. The right of cancellation does not apply to consumers who do not belong to a member state of the European Union at the time the contract is concluded and whose sole residence and delivery address are outside the European Union at the time the contract is concluded.
You can cancel your order without giving a reason by declaring your cancellation in writing no later than 14 days after delivery of the goods and / or by returning the goods to us in their original condition. In the event of cancellation, the purchase price will be fully refunded. If the returned goods do not correspond to the goods ordered, Jungle Leaves also bears the shipping costs and the return costs. You are not entitled to the right of withdrawal if the goods are no longer in the condition in which they were delivered.
We expressly do not assume any guarantee of growth and success.
We always try to identify the plants correctly. Often, however, there are changes in the nomenclature within a short period of time or plants are generally in circulation under the wrong / old name. Guarantee for the species and variety is therefore only provided within the revocation period of 14 days and only up to the amount of the invoice. Further claims by the customer, regardless of the legal grounds, are excluded.
The delivered goods remain the property of Jungle Leaves until they have been paid for in full. This reservation is not lifted by the further cultivation of the plants supplied and, in the case of foreseeable insolvency, requires our consent for resale.
The place of fulfillment for all deliveries is the registered office of the seller; this also applies to contracts with business people, legal entities under public law or special funds under public law. Only the law of the Federal Republic of Germany applies.
